Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you and AscendX Innovations Pvt. Ltd. ("AscendX", "we", "our", or "us"), the company behind AlignAI. By accessing or using the AlignAI platform including our website, web application, APIs, and any related services (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an institution or organisation, you represent that you have authority to bind that organisation to these Terms.
Description of Service
AlignAI is an AI-powered teaching management platform that helps educators automate administrative tasks including test generation, grading, attendance tracking, gradebook management, lecture transcription and summarisation, assignment management, and student communication via WhatsApp, Telegram, and Email. The Service is intended for use by teachers, educators, coaching institutes, schools, colleges, and online educators. It is not intended for use directly by students under 13 without appropriate institutional oversight.
Accounts & Registration
Account Creation
To use AlignAI, you must register for an account by providing accurate and complete information. You are responsible for maintaining the security of your login credentials and for all activities that occur under your account.
Account Types
AlignAI offers individual teacher accounts and institutional accounts. Institutional accounts may have additional administrators who can manage multiple teacher accounts and student data.
Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods. You may delete your account at any time by contacting contact@alignai.in.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to:
- Use the Service to harass, abuse, or harm any individual, including students.
- Upload or process content that is illegal, defamatory, obscene, or infringes third-party intellectual property rights.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use automated scripts or bots to scrape or extract data from the Service without our written consent.
- Share your account credentials with unauthorised third parties.
- Use the Service to send unsolicited bulk communications (spam) to students or parents.
- Circumvent or disable any security features of the Service.
- Use the AI features to generate content intended to deceive, defraud, or mislead students or parents.
- Process sensitive personal data (health records, financial data) through the Service beyond what is needed for educational administration.
AI Features & Limitations
AI-Generated Content
AlignAI uses artificial intelligence to generate tests, summaries, notes, grades, and other content on your behalf. All AI-generated outputs are provided as assistive tools only. You are solely responsible for reviewing, editing, and approving AI-generated content before using it in an official educational capacity.
No Guarantee of Accuracy
AI outputs may contain errors, hallucinations, or inaccuracies. AlignAI and AscendX Innovations make no warranty that AI-generated content is accurate, complete, or suitable for any particular purpose. Do not rely on AI outputs without human review.
Teacher Copilot
The Teacher Copilot executes real actions (sending messages, updating grades, creating tests) based on your natural language commands. You are responsible for reviewing commands before execution. AscendX is not liable for unintended actions resulting from ambiguous or incorrect commands.
Data Ownership & Licences
Your Data
You retain ownership of all data you upload or create on the platform, including student data, lecture content, and assessments. You grant AscendX Innovations a limited, non-exclusive licence to process this data solely for the purpose of providing the Service to you.
AlignAI Content
All software, UI design, branding, documentation, and non-user-generated content on the AlignAI platform is owned by AscendX Innovations Pvt. Ltd. and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, including improving the Service.
Student Data Responsibilities
If you use AlignAI to manage student information, you represent and warrant that: You have obtained all necessary consents and permissions from students, parents, or guardians as required by applicable law (including but not limited to FERPA, DPDP Act 2023, or other applicable data protection laws in your jurisdiction). You will use student data only for legitimate educational purposes and in accordance with your institution's data protection policies. You will not upload sensitive student data (such as health, financial, or biometric data) beyond what is necessary for educational administration. You acknowledge that you are the data controller for student data you upload, and AscendX Innovations acts as a data processor on your behalf.
Payments & Subscriptions
Free & Paid Plans
AlignAI offers a free tier with limited features and paid subscription plans with expanded capabilities. Details of current plans and pricing are available at alignai.in/pricing.
Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by applicable law or as stated in our Refund Policy.
Changes to Pricing
We reserve the right to change pricing at any time. We will provide at least 30 days' notice of price changes for existing subscribers. Continued use after the effective date constitutes acceptance of the new pricing.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ASCENDX INNOVATIONS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR SUITABLE FOR YOUR INTENDED USE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASCENDX INNOVATIONS PVT. LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
Governing Law & Disputes
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi, India. Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you via email or an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date of updated Terms constitutes your acceptance. If you do not agree to updated Terms, you must stop using the Service before the effective date.
